Welcome to Beach Reports (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our location-based mapping app (“App”), which allows users to contribute real-time comments and conditions about beaches. By accessing or using Beach Reports, you agree to these Terms. If you do not agree, please refrain from using the App.

1. Use of the App

1.1 Eligibility: To use Beach Reports, you must be at least 13 years old. By accessing or using the App, you represent and warrant that you meet this age requirement.

3. Intellectual Property

All content and materials within the App, including text, graphics, logos, and software, are owned by Beach Reports or licensed to us and are protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App without our express written permission.

4. Location Services

The App uses location services to provide real-time beach conditions. By using the App, you consent to the collection and use of your location data as outlined in our Privacy Policy. You can enable or disable location sharing through your device settings.

5. Disclaimer of Warranties

The App is provided “as is” and “as available.” Beach Reports makes no warranties, express or implied, regarding the reliability, accuracy, or availability of the App or the content shared by users. You use the App at your own risk.

6. Limitation of Liability

To the fullest extent permitted by law, Beach Reports and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, or personal injury.

7. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and without notice. Upon termination, your right to use the App will cease immediately.
